Judge Strikes Down Georgia Pro-Life Law
Fulton County Superior Court Judge Robert McBurney on Tuesday overturned Georgia’s ban on abortions past six weeks of gestation, ruling it unconstitutional.
When the law was enacted in 2019, Roe vs. Wade made it illegal for states to ban abortions before viability, McBurney argued in his ruling.
While the law has only been enforced since the repeal of Roe, it “did not become the law of Georgia when it was enacted and it is not the law of Georgia now.”
